Buyers, sellers or parties abroad increasingly want to sign property purchase contracts digitally. This can simplify logistics, but it does not answer every form question.

This article deals with the digital signing route in a property purchase contract. It does not replace general pages on certification, powers of attorney or foreign-language documents.

From a legal perspective it must be clear in advance which part can be electronic and which part needs a special form for the land register, registration consent, power of attorney or certification.

The document basis is not sufficient yet.

Request the missing documents first. Without them, it is not possible to assess whether purchase price, escrow, handover or land register security are properly regulated.

A binding offer should not leave this gap open.

The basis is documented, but the contract must be read carefully.

If documents and draft contract match, the starting point is better. Still check maturity, assurance, retention, withdrawal right and handover consequences in detail.

The risk is not sufficiently protected in the contract yet.

If the draft remains general, it should be revised before signing. Depending on the situation, a condition, purchase price retention, seller assurance or clear handover mechanism may be appropriate.

Separate signature and certification

An electronic signature is not automatically the same as a certified signature. Special form requirements may apply for land register completion.

The contract should therefore address not only signing but also proof of identity and usability for the land register.

Secure consent and land register usability

In a property purchase, the final question is whether the documents can be used for the land register application. A technically valid signature is not enough if land register usability is missing.

Before signing, it should be clear which documents are created electronically and which need certification or original form.

Check power of attorney and cross-border elements

Where a party is represented or located abroad, a quick digital signature is often not enough. Power of attorney, translation and certification route must fit together.

That depends on the concrete form route and the purpose of the document. Land register requirements must be checked separately.

Does a qualified electronic signature replace certification? +
