When buying property in an Austrian military restricted area, assess the parcel boundary and intended access separately. The regulation must include the parcel, and a statutory exception or specific permission must cover the planned entry. Proximity to a military site does not establish either point.

Section 2 of the Austrian Sperrgebietsgesetz 2002 governs publication and posting of the regulation. Section 3 generally prohibits entry and driving into a restricted area and sets out statutory exceptions and the possibility of permission.

Which regulation defines the restricted area?

Section 2 of the Sperrgebietsgesetz 2002 sets out how a restricted-area regulation is published or posted, depending on its legal basis. The regulation identifies the area covered. Its boundary description and any plans it identifies determine the line to be checked for the purchase.

How does the boundary relate to the parcel?

Compare the cadastral municipality and parcel number in the purchase documents with the boundary description and any plans it identifies. This links the regulated area to the property being bought.

If the boundary crosses or runs close to the parcel and the documents do not show its line clearly, the affected area remains uncertain. Resolve that point from the identified documents before arranging a viewing inside the area or making the purchase depend on it.

Who may enter or drive through a restricted area?

Section 3(1) of the Sperrgebietsgesetz 2002 generally prohibits entering or driving through a restricted area. Section 3(2) exempts Austrian citizens acting in military matters. The prohibition also does not apply to the bodies listed in that provision when they must perform an official act in the area. Check whether the specific person and activity fall within one of those statutory exceptions.

For other people, section 3(4) allows the competent military authority to grant permission for important reasons, including personal or economic reasons, subject to military considerations. A private buyer should establish whether permission is required before arranging a viewing. The fact that the law allows permission does not guarantee it will be granted.

Does ownership automatically permit entry?

Section 3 of the Sperrgebietsgesetz governs access to the restricted area. It contains no general exception for owners and does not, by itself, establish a general prohibition on acquiring ownership.

This does not resolve the specific purchase. Any separate acquisition requirements are a different question from the access rule in section 3.

What should be confirmed before signing?

Use the same cadastral municipality and parcel number in the draft contract, land-register extract and boundary documents. If a viewing or planned use is important to the purchase, establish whether permission under section 3(4) is required and which person, purpose and period it covers.

The contract can address which documents the seller provides and how the parties deal with access that remains uncertain. An agreement between the parties cannot replace any permission required by law. Make an essential access issue part of the contract review before signing.

Overview of all answers.

01

The boundary documents place the parcel outside this restricted area.

Keep the regulation and cadastral comparison with the purchase file. Section 3 applies to the declared area; this conclusion does not assess other possible restrictions.
02

The documents do not yet establish whether the property lies within the restricted area.

Request the regulation in force and the boundary documents it identifies. If it refers to a plan, match it to the cadastral municipality and parcel number in the purchase documents. If the boundary still cannot be matched, obtain a property-specific clarification before planning a viewing or relying on the assumed location.
03

The parcel location and intended access have been checked separately.

Keep the boundary documents separate from the legal basis for access. Check whether it covers the person and purpose of the planned visit. It should not be treated as general permission for other visits or uses.
04

The parcel location is known, but the intended access remains unresolved.

Do not enter or drive into the area solely because you own the property or plan to buy it. Check whether a statutory exception applies or whether permission from the competent military authority is needed. Keep this access question separate from whether title may be acquired.
FAQ

Frequently asked questions about restricted land

Does permission automatically cover later visits? +
That depends on the scope of the permission. Check whether it covers the specific person, purpose and period. Clarify any later use separately before relying on it.
Can the boundary run through a parcel? +
If the regulated boundary divides a parcel, use the boundary description and any plans identified in the regulation to determine the area covered. The property address alone does not resolve that question.
