Land Register

The public register of land and the rights attached to it, kept by the district courts; it enjoys public faith, so a good-faith buyer may rely on its contents.

In brief

The Austrian land register (Grundbuch) consists of the main book (sheets A, B and C) and the collection of deeds. Sheet A describes the property, sheet B records ownership, and sheet C lists encumbrances such as mortgages, easements or a right of first refusal.

Because of the principle of reliance, a good-faith purchaser may trust the recorded status. Ownership only passes upon registration of title, not already upon signing the contract.
