Energy Performance Certificate
A document on the overall energy efficiency of a building; the seller must present and hand it over, otherwise at least an average efficiency is deemed agreed.
Under the EAVG 2012 the seller is obliged to present the energy performance certificate to the buyer at the latest upon conclusion of the contract and to hand it over. The certificate informs about the heating demand and the overall energy efficiency factor.
If no certificate is handed over, an overall energy efficiency corresponding to the age and type of the building is deemed agreed; the buyer may sue for its presentation or obtain a certificate himself. The values shown may constitute warranted characteristics.

Warranted Characteristics
Characteristics the seller expressly or implicitly assures; their absence triggers warranty even where warranty is otherwise excluded.

The seller's no-fault liability for the property having the stipulated or ordinarily expected characteristics at the time of handover.

The written documentation of the condition of the property at handover, including meter readings, keys and any recorded defects.
